Catholic Care (Diocese of Leeds) is to appeal to the Charity Tribunal once again over the Charity Commission’s refusal to allow it to prevent same-sex couples from using its adoption services.
The move comes after the Commission refused to allow the charity to change its objects in order to maintain the discrimination, despite having been forced by a High Court ruling to reconsider the case.
The charity’s first appeal was rejected by the Tribunal in June last year, leading it to take its case to the High Court.
Benjamin James, a partner at Bircham Dyson Bell who is handling the appeal, said there were significant discrepancies in the Commission’s second decision which need to be clarified.
“The guidance that was issued by Sir Michael Briggs and the High Court doesn’t necessarily tie in with the way that the Commission dealt with their response.”
The appeal was filed at the end of September, with the Commission being given 28 days to respond.
